This notice describes how the

processes your personal data (in accordance with Art. 13 para. 1 GDPR)

1. Purposes of the data processing

We will process your personal data for the following purposes
a) Permanent car park management

  1. Tariff calculation for registered short-term parking customers
  2. Checking the terms of use (e.g. parking over two spaces)
  3. Control of legally compliant use (e.g. exceeding the free parking time)
  4. Protection of the facilities (e.g. vandalism)
  5. Prosecution of misuse (e.g. exit without payment)

 

We collect this data by means of

  • the data provided by you for the creation of the contract
  • Image recording, evaluation of the licence plate data

 

The provision of your personal data is voluntary. Reference is made to image recording and the collection of licence plate data in accordance with legal requirements.

 

2. Legal basis for processing

  • The legal basis for the billing of parking fees (both for short-term and long-term parking) is ‘fulfilment of contract’ (Art. 6 para. 1 lit. b GDPR)
  • The legal basis for licence plate recognition for long-term parkers is your consent (Art. 6 para. 1 lit. a GDPR)
  • For licence plate recognition for short-term parkers, the legal basis is the legitimate interest of the controller (Art. 6 para. 1 lit. f GDPR), which consists of achieving the purposes mentioned above under point 1 (a to f). Against this

You have the right to object to this data processing in accordance with Art. 21 para. 1 GDPR if there are reasons arising from your particular situation.

  • For image processing, in particular of the entrance and access area, the entrance and exit gates, the cash registers and vending machines, the stairwells and the car park decks in accordance with Section 12 para. 3 no. 2 DSG. The image recordings are only analysed in the event that either the monitored object itself (garage) or vehicles parked in it have been the subject of an infringement.

 

3. Transmission of your personal data

For the above-mentioned purposes, your personal data will be transmitted to the following recipients - if necessary:

  • Processors (e.g. call centre, complaint management)
  • Billing platforms (fuel cards, mobility cards, etc.)
  • Insurance companies (e.g. in the event of damage)
  • Debt collection agency, lawyer, courts
  • Authorities within the scope of their remit
  • Client of the garage operator as operator


4. Storage period
4.1. For unregistered customers:

For normal parking transactions, the licence plate image is usually anonymised 24 hours after the last recorded action[1]. In the case of completed parking transactions with outstanding costs, anonymisation takes place 2 days after the reminder. This data is required as evidence for the warning and in the event of disputes. Unregistered customers who leave within the free period or turn around when entering are anonymised after 5 minutes. The remaining data will be deleted after the tax retention period of ten years has expired.

 

4.2. For registered customers:

Your personal data will only be retained by us for as long as is necessary to fulfil the contract in order to achieve the purposes stated under point 1: 

  • Parking transactions by registered customers which have not generated any costs: 12 hours after the last recorded action1.
  • For the settlement of parking times with payment on account: 12 hours after invoicing (monthly invoice).
  • Completed parking transactions with outstanding costs: 2 days after reminder.
  • The remaining data will be deleted after the retention period of seven years under tax law has expired.
  • For long-term parkers, the following also applies: For regularly completed parking transactions: the last 30 movement data (information on entry and exit, including image of the vehicle licence plate number) for the purpose of tracing misuse and billing for parking overtime.

 

5. Image processing (‘video surveillance’):

Recorded data must be deleted or anonymised after 14 days at the latest, unless they are required for specific reasons for the realisation of the underlying protection or preservation of evidence purposes or for purposes pursuant to Section 12 para. 3 no. 2 DSG. The deviation from the statutory deletion period of § 13 para. 3 DSG is required to determine payment defaults of credit card transactions, as the garage operator only learns after up to two weeks that a credit card transaction has not been carried out by the bank. Without storage for 14 days, it would no longer be possible to assert claims. The use of the records for other purposes is not permitted. 

 

6. Your rights in connection with personal data

You have the rights to information, rectification, erasure, restriction, data portability and objection. Please contact us for this.

If you believe that the processing of your data violates data protection law or your data protection rights have been violated in any other way, you can lodge a complaint with the data protection authority.

If the processing is based on your consent, you can revoke this at any time.

With regard to image processing, data subjects are not entitled to receive photographs from the garage operator, without prejudice to the right to information pursuant to Art. 15 GDPR, if this would adversely affect the rights and freedoms of other persons. Instead, the data subject will receive a description of their behaviour. However, the garage operator is entitled to transmit image recordings to the competent authority (such as a security authority as part of an investigation initiated by a complaint) because the garage operator has a reasonable suspicion that the data could document a criminal offence to be prosecuted ex officio. Such a suspicion may also arise from a tip-off from a customer.
